Draft — pending attorney review
This is a first-pass draft, not final legal text. Sections marked [REVIEW] need explicit confirmation before this page is treated as binding.
Terms of Service
Draft — not yet in effect
These Terms of Service govern use of deletemyaidata.com (the “Service”), operated by [REVIEW: legal entity name — Sawtelle Media?] (“Company”). By using the free scan, purchasing a one-time scan, or subscribing to Monitoring, you (“Customer”) agree to these Terms.
1. The Service
- Company operates an AI data privacy scanning service. The Service queries third-party AI models with Customer’s provided identity information (name, and optionally city and employer) and reports what those models say back, classified by risk category.
- Customer accepts these Terms by using the free scan, by completing a Stripe checkout for a paid offer, or by continuing to use the Service after a posted update to these Terms.
- The Service is available in three forms: a free teaser scan, a one-time paid scan, and a recurring Monitoring subscription. See Section 2.
2. Plans, Billing, and Cancellation
- Free scan: no charge, runs a limited subset of the model roster.
- One-time scan: a single flat fee, billed once through Stripe. Runs the full active model roster and produces a complete report.
- Monitoring: a recurring monthly subscription billed through Stripe. Includes the first scan and recurring rescans on a regular cadence for as long as the subscription is active.
- Customer can cancel Monitoring at any time. [REVIEW: self-serve cancellation flow not yet built — until it ships, this section should describe the actual cancellation mechanism, not a dashboard button that doesn’t exist]
- [REVIEW: refund policy — not yet decided, see ROADMAP.md]
3. How Scans Work — Important Limitations
- A scan reflects what a specific set of AI models said, in response to specific prompts, on a specific date. AI models are updated and retrained on an ongoing basis; results can and do change over time, and a scan that finds nothing is not a claim that no information about Customer exists anywhere, now or in the future.
- AI models can state things that are inaccurate, outdated, or entirely fabricated, about Customer or anyone else. Company classifies each finding by how traceable it is to an identifiable public source, but does not and cannot independently verify the truth of any individual model response. Findings labeled as unconfirmed are presented as unconfirmed, not as fact, and should not be relied upon as accurate without independent verification.
- Company does not control, and makes no warranty regarding, the accuracy, completeness, or behavior of any third-party AI model queried as part of the Service.
4. Action Plans — No Guarantee of Removal
- Where a Monitoring subscription includes an action plan for a finding, that plan is informational guidance, not a service performed on Customer’s behalf. Company does not submit removal or opt-out requests to third parties for Customer, and does not guarantee that following any action plan will result in information being removed, corrected, or excluded from any AI model, data broker, or other third party.
- Company is not a law firm, does not provide legal advice, and no attorney-client relationship is created through use of the Service.
5. Third-Party AI Providers
- Running a scan sends Customer’s provided identity information to third-party AI model providers (directly, or via an aggregator) in order to query them. Company is not responsible for how those third parties process, retain, or otherwise use information submitted to them as part of a query, beyond what is disclosed in Company’s Privacy Policy.
6. Account Use
- The Service is intended for Customer to scan their own identity. Customer represents that any name, city, or employer information submitted is their own or, where the Service explicitly permits submitting information about another person, that Customer has that person’s knowledge and authorization to do so.
7. No Guarantees
- Company provides the Service on a best-efforts basis and makes no representation or warranty about the completeness of any scan, the accuracy of any AI model output, or the outcome of following any action plan.
8. Limitation of Liability
- To the maximum extent permitted by law, Company will not be liable for any indirect, incidental, special, or consequential damages arising from use of the Service.
- Company’s aggregate liability under these Terms will not exceed the fees paid by Customer to Company in the twelve (12) months preceding the claim.
9. Choice of Law
- [REVIEW: jurisdiction — draft assumes California, matching DUPAY’s own choice-of-law clause and the Sawtelle Media Stripe account’s apparent California basis. Confirm before finalizing.]
10. Changes to These Terms
- Company may update these Terms from time to time. Continued use of the Service after an update constitutes acceptance of the revised Terms.
